By agreeing to these Terms and Conditions, you confirm your understanding and acceptance of this provision. 2.ARABIAN LAMAA FOR DIGITAL AGGREGATION SERVICE 2.3 Arabian Lamaa For Digital Aggregation merely operates the Platform for facilitating its services. Arabian Lamaa For Digital Aggregation helps with onboarding the users to the Platform and managing the relationship within the scope of the service they selected on the platform. It will provide a helpline and customer care numbers for all its users for assistance related to the transactions on the Platform. 2.4 Arabian Lamaa For Digital Aggregation does not underwrite/guarantee the performance of the obligations of any party. Further, Arabian Lamaa For Digital Aggregation shall not be required to provide any security/undertakings to the user or any party pertaining to any bidding or payment. The user agrees that it shall have no recourse whatsoever against Arabian Lamaa For Digital Aggregation for any default/non-compliance. 2.6 You are responsible for understanding and accepting all fees associated with the services you choose on our platform, as specified during the payment process. Any dispute, controversy or claim arising out of or relating to this contract, or the breach, termination or invalidity thereof, shall be settled by arbitration administered by the Saudi Center for Commercial Arbitration (SCCA) in accordance with its Arbitration Rules. 8.3 Cooperation Obligation: You agree to cooperate fully with Arabian Lamaa For Digital Aggregation as permitted by Applicable Laws, including providing written answers or information for internal investigations. 8.4. Information Disclosure: Arabian Lamaa For Digital Aggregation may disclose information about you to regulators under Applicable Laws, bank card association rules, or as approved by the Saudi Central Bank or other local financial institutions. 8.5 If any term or provision of these Terms and Conditions is deemed invalid, it shall not affect the validity of the remaining terms. 8.6 Effective Duration: these Terms and Conditions become effective upon accessing Arabian Lamaa For Digital Aggregation platform and remain in effect until canceled or revoked by Arabian Lamaa For Digital Aggregation at its discretion. 8.7 Termination Notice: If Arabian Lamaa For Digital Aggregation deactivates your access, terminating these Terms and Conditions, you will be notified via the provided email address. HANDLING COMPLAINTS 9.1 Commitment to Excellence: We are dedicated to delivering an exceptional standard of service to our customers. Your feedback is highly valued as it aids us in continuous improvement. If you believe our service can be enhanced or if you encounter any issues, please share your feedback with us. 9.2 Arabian Lamaa For Digital Aggregation will follow the Saudi Arabian Monetary Authority (SAMA) guidelines for complaint handling, ensuring that each complaint is documented upon receipt and a reference number is sent to the complainant's registered mobile number to facilitate follow-up. 9.3 Complaint Handling Process: Upon receiving your complaint, Arabian Lamaa For Digital Aggregation will: (I) document your complaint and send a reference number to your registered mobile number for tracking and follow-up; (ii) acknowledge receipt of your complaint within one (1) business day and provide an estimated resolution date; (iii) assign unresolved complaints from the Call Center to the Customer Success & Complaint Management (CSU) unit for further investigation and ensure the complaint is entered into the Customer Relationship Management (CRM) system with a unique case number; (iv) assign your complaint to the relevant department and inform you of the officer handling the complaint, along with an expected resolution date; (v) strive to resolve your complaint within fifteen (15) business days of submission. If additional time is needed, we will inform you of the revised timeline and provide progress updates; (vi) offer you the option to escalate the complaint to higher management within Arabian Lamaa For Digital Aggregation, should you be unsatisfied with the resolution, and direct you to the appropriate authority if needed; For further information on the complaints process, please contact cs@Lamaa.sa. 10. TERM AND TERMINATION 10.1Agreement Duration: This Agreement is effective from the Effective Date and remains in force until terminated as per the Agreement's provisions ("Term"). 10.2 Termination without Cause, Either Party may terminate this Agreement without cause by providing a 30-day prior written notice to the other Party. 10.3 Automatic Termination: This Agreement terminates immediately if a Party is declared bankrupt, faces bankruptcy proceedings, dissolution, or liquidation, or is unable to meet its financial obligations leading to a court-approved winding-up petition. 10.4 Obligations Post-Termination: Termination does not absolve the user for the pending obligations and liabilities under this Agreement. 10.5 Return of Materials: Upon termination, both parties must promptly return all materials and Confidential Information. Client records are retained for 5 to 10 years per SAMA regulations. 10.6 Survival of Provisions: Certain provisions, including Term and Termination, Indemnity and Limitation of Liability, Confidentiality Obligations, Governing Law and Jurisdiction, Dispute Resolution, and Notices, survive the Agreement's termination. 11.INNACURACY PROVISION 11.1 Error Resolution: Upon detecting any error or malfunction in your Arabian Lamaa For Digital Aggregation Platform Account, we will promptly: - Return any collected amounts related to the error. - Correct the error for affected customers within sixty (60) business days. - Notify you of the error and the corrective measures taken. 12. Data Protection Lamaa is committed to safeguarding your personal data in line with the Kingdom of Saudi Arabia’s Personal Data Protection Law (PDPL). We collect and use your data solely for legitimate business purposes and will not share it with third parties without your consent unless required by law. You have the right to access, correct, or delete your data. For any requests or inquiries, please contact us at privacy@lamaa.sa. We may update this policy as needed, and your continued use of our Website will constitute acceptance of any changes. 13. ENTIRE AGREEMENT 12.1 Comprehensive Agreement: These Terms and Conditions, along with any mutually agreed agreements or terms, constitute the entire agreement between you and Arabian Lamaa For Digital Aggregation. 13.2 Authorization Acknowledgment I, the undersigned, agree to provide Arabian Lamaa For Digital Aggregation for information technology with necessary information for establishing, auditing, or administering my accounts. I authorize the collection of required information from the Saudi Credit Bureau (SIMAH) and its disclosure to SIMAH as per the Membership Agreement and Code of Conduct approved by the Saudi Central Bank.
1.2 By clicking the "We agree to the Terms and Conditions" checkbox associated with this Terms and conditions and by accessing and using the platform through any device or format, you agree to be bound by the terms of this agreement. Arabian Lamaa For Digital Aggregation reserves the right to terminate your account at any time, with or without notice, if your conduct breaches this agreement.
1.3 Your access to the Website is limited to purposes relevant to the services provided by Arabian Lamaa For Digital Aggregation under the applicable agreement for the service you entered into or to be entered into between the Provider and you (referred to as the "Services Agreement").
2.1 The User is granted an access and utilize Arabian Lamaa For Digital Aggregation platform for its services, this access is subject to the terms and conditions set forth herein, outlining the permissible scope of the user's interaction with the platform.
2.2 Platform is a technology solution provided by Arabian Lamaa For Digital Aggregation. It provides an avenue for users to aggregate, analyze and approve payments offers across different operational units spread across different geographies through its online cloud-based platform.
2.5 Arabian Lamaa For Digital Aggregation does not have any proprietary interest in any of its services and merely provides a platform to undertake the transaction. No act of Arabian Lamaa For Digital Aggregation as a facilitator shall be construed as legal advice or recommendation with respect to the transaction.
2.7 You acknowledge that you are fully responsible for any service required, Transaction bidding session, or any fees
2.9 By agreeing, you recognize that Arabian Lamaa For Digital Aggregation can check your credit score, get your credit report, and confirm your identity using the Unified National Access (NAFATH), Commercial Registration Number, or other relevant sources. You also acknowledge that Arabian Lamaa For Digital Aggregation may consider your credit report when deciding on your payment request, based on your repayment history and credit behavior. Additionally, Arabian Lamaa For Digital Aggregation may disclose the aggregated information with the Saudi Credit Bureau (SIMAH) or any other entity approved by the Central Bank of Saudi Arabia (SAMA).
2.10 You hereby acknowledge and agree that you are the true and sole beneficiary of the Arabian Lamaa For Digital Aggregation Services, using them solely for lawful purposes in compliance with all applicable laws and regulations of the Kingdom of Saudi Arabia. You further represent that you will not use Arabian Lamaa For Digital Aggregation Services for any activities related to money laundering, financing of terrorism, or any other illegal activities. By accepting these Terms, you confirm your understanding and commitment to uphold these obligations
8.9 The user permits Arabian Lamaa For Digital Aggregation to use its name and/or logo on Arabian Lamaa For Digital Aggregation 's website and marketing materials.
